Doping Clause: The athlete agrees not to use any doping substances, in accordance with international competition regulations such as Hyrox or Ironman. Any violation will result in the immediate termination of the contract and expulsion from the training program without the right to a refund. • Use of Training Programs: The training programs provided by Pele Performance are for the athlete's exclusive and non-transferable use and may not be distributed, disclosed, shared, or commercialized with third parties, except for use within private groups expressly subscribed to the Hyrox Gym service. Breach of this provision will result in a penalty equivalent to $3,450 USD, corresponding to the value of one year of the 1-1 personalized training program, without prejudice to other legal actions that Pele Performance may exercise. • Social Media Tagging: If the athlete shares workouts, results, or mentions of the program on social media, they must tag @pele_performance before starting the workout. Noncompliance with this clause may result in suspension of access to future training. • Prohibition of Commercialization: The training plans, methodologies, or routines provided may not be used for commercial purposes or shared publicly or privately without the explicit consent of Pele Performance. • Result Responsibility: The results obtained depend on multiple factors such as dedication, consistency, and prior physical condition. Pele Performance does not guarantee a specific result, although the necessary resources will be provided to maximize the athlete's performance. • Exclusivity: The athlete agrees not to exchange training programs with other coaches or programs without prior consent from Pele Performance, in order to avoid any type of misalignment and/or interference in the progression of the plan designed by Pele Performance. • Jurisdiction: The parties agree to attempt to resolve any dispute that may arise in the execution of this contract amicably. In the event of a conflict, the parties shall submit any divergences that may arise concerning the interpretation or compliance of this contract to the competent jurisdiction of the courts of Chicago (USA), expressly waiving their own jurisdiction.
